What is Charity Public Liability Insurance?

Charity public liability insurance is put in place to protect against compensation claims made from members of the public, such as clients, event attendees, customers and/or contractors.

In the same way as a business, not-for-profit organisations have a duty of care to staff to any member of the public and/or clients to ensure all activities are conducted responsibly to avoid accidents or injuries. If your organisation is in breach of this duty, and as a result, injury or damage is caused, then any injured party could make a claim against your organisation for the damages – and these claims can be surprisingly costly.

Injury or illness to employees and/or volunteers whilst working under the instruction of the Charity would be covered under Employers Liability Insurance, which can be added to the Public Liability policy as required.

Charity public liability is becoming a much more sought after area of insurance, as many companies will request copies of your public liability insurance before they allow you to hire out their premises, undertake a fundraising event on their site or even when you bid for funding.

Do I need Charity Insurance?

In most cases, it is unusual that a charity or non-profit organisation does not need to consider charity insurance.

In fact, our charity Public Liability insurance is often a key enabler of their services, events and fundraising activities. You might find without it, if your charity meets in a hall or other public space, you will likely be asked to provide a copy of your liability certificate.

Similarly, if you are running a fundraising event the local authority may seek proof of cover before commencement.

All registered charities will have exposure to risk and a requirement for insurance protection. Core cover is typically Public and Products Liability for general fundraising, meetings and events.

You can then extend cover for your legal liability to any employees and volunteers (employers liability). This additional cover will cover for volunteers against accidental property damage or injury to the public.

Working with these groups it’s important that extra measures for safety are in place and security measure are in place to protect them. One of these measures is our charity insurance, which will support you and your charity should a civil case arise. Additionally, your charity may host fundraising events, community visits or beach cleaning expeditions, these events are often huge successes for charities and often take months to develop and organise operations. You may choose to put on transport, celebrate with fireworks, or provide PPE and equipment for litter picking, each of these operations will need special consideration and appropriate insurances in place. Our advisors can build a bespoke charity insurance policy tailored to your needs and activities.

Our menu style approach to small charity cover means that you only pay for the specific sections you need, keeping costs as low as possible. Public Liability cover only starts from as little as £60 (plus insurance premium tax) per annum, with interest-free payment facilities for premiums over £120 per annum.

Public liability insurance for charities is not a legal requirement. However, given the risks involved with supporting the public and running fundraising events, it can still be a good idea to investigate taking out public liability cover for your organisation. Equally, some third party contracts may require you to have a specified level of public liability cover in place.

Every single charity will have different risks and requirements depending on their specific activities. Public liability limits range from a minimum of £1m to £5m and you should consider what would work for you. If you are running events with a large number of attendees, then higher limits would be recommended.

While public liability insurance isn’t a legal requirement, if you have employees it’s a legal requirement to have at least £5 million employers’ liability insurance in place – you could be fined up to £2,500 for every day you don’t have it!
