You receive notification from the solicitor of one of your care staff who has been off with a back injury. It is alleged that correct lifting training was not provided and this has led to the back problem, the claimant is seeking compensation for the injury which has also impacted their ability to play sport.
Each care home policy is calculated individually depending on your specific requirements. The location of the home (post-code), number of patients, residents and/or staff, construction of the property and the individual level of sums insured will all impact the insurers pricing.
Several well publicised examples have highlighted the risk of both abuse claims and accusations of abuse in the care sector. With this in mind it is important that care homes ensure that their current public liability insurance does not contain an abuse exclusion.
Should an accusation of abuse arise, and an exclusion be present in the policy wording, the insurer is likely to decline any claim leaving you to manage the claim and any financial compensation yourself.
