Not only does Medical or Professional Indemnity cover your business losses, but it also protects your patients. With appropriate insurance, you can ensure that your patients get adequate compensation if they suffer any physical or mental harm as a result of a treatment you have provided.

In some cases, your professional body will provide indemnity on a discretionary basis. A comprehensive insurance policy with Insync will give you peace of mind that you will be covered in the event of a claim.

Occurrence Based
Occurrence-based indemnity provides cover for incidents which occur during the policy or membership period, regardless of when the claim for that negligence is made. All NHS indemnity schemes prove occurrence-based cover.

Claims-Based
Claims based indemnity only provides cover for incidents which occur during the policy or membership period, provided that the claim is made and reported prior to the end of this period.
Once the policy or membership has lapsed, no cover will be offered in respect of new claims not reported during the policy or membership period.

Run-off cover in the form of an extended reporting period, can be arranged to ensure you remain protected against any further claims that were accrued but not reported during their policy or membership period.

Contractual and Discretionary Indemnity
Contractual indemnity is a contractual obligation to compensate for some defined loss or damage, by making a money payment.

Discretionary indemnity is where legal and financial assistance is provided at the discretion of the provider, for example, not backed by an insurance contract between the healthcare professional and the provider. Medical Defence Unions all work on a discretional indemnity basis, and there is no guarantee any claim will be honoured.

In the UK, it is a legal requirement for many practising medical professionals to hold valid and sufficient medical indemnity insurance. This includes general practitioners, surgeons, nurses, dentists, midwives, osteopaths, radiographers, sonographers, pharmacists, opticians, and more paramedics. In most cases, it is a regulatory requirement for governing bodies such as the GMC and GDC who are.

If you are working in private healthcare, you are responsible for your medical indemnity insurance. Often, if you are employed, you will be insured under your employer’s medical indemnity or malpractice insurance. However, this is not to be assumed, and it is your responsibility to check.

Any independent practitioners must ensure they have adequate insurance; this applies to any work carried out outside of employment, including Good Samaritan acts.

Professional Indemnity only provides cover for claims against you for financial loss relating to your professional negligence; as such, medical indemnity insurance is critical for all clinicians and medical professionals.

As a medical practitioner, the appropriate level of indemnity will depend on a few factors. We will calculate your insurance premium based on the type of professional advice and treatments you are providing regularly, the frequency of your private practice, your annual income, to name a few.

You wouldn’t be the first to think that public liability should cover any accidents, injuries or damage to the general public or third party. However, this may be the case for some professions, but this is not the case in the medical industry, where accidents or injuries are a direct result of your professional care and/or treatments.

The main difference is public liability will cover third-party incidents closer related to general health and safety breaches, for example, a trip on a rug in the reception. Public liability insurance does not stretch to an injury as a result of your treatments, therapies or client advice. This is why malpractice insurance is essential to cover your career and livelihood for this type of career. Any claims as a result of an injury are upsetting and stressful; what’s more, they also cost you valuable time, and money and, in the worst cases, could cost your reputation.

Unless already provided by your employer, we would recommend you to have both public liability and medical malpractice insurance in place, especially as your line of work involves many clients or patients on a day-to-day basis. This means you’re covered for professional mishaps as well as non-medical unrelated trips and accidents. Malpractice insurance claims can be a result of any medical treatment or diagnosis but more often come as a result of a physical treatment performed on the client. However, this is not always the case, as there are many other injuries patients could suffer as a result of wrongly prescribed medicines, allergic reactions or suffer other long-term consequences. These types of claims are also covered with malpractice insurance, and you can be sure that you’ll be protected for negligent diagnosis, advice given to clients and physical treatments.

Medical indemnity cover is written on a “claims made” basis; what this effectively means is that you need cover in place when a claim is reported as well as when the medical procedure was carried out.

Whilst you maintain insurance throughout your career, this is not an issue, but should you cease to practice or retire, you will need to arrange run-off cover or an extended reporting period.

Whilst some insurers will only provide a three-year reporting period aligned to the statute of limitations, we will work with you to build a more comprehensive solution depending on your role.

Doctors have been known to receive claims up to 10 years or more post-retirement, and such incidents may not be statute-barred as the three-year period will begin from the point of diagnosis.
